Welcome to Surge Media! These Terms of Service (“Terms”) govern how we work together; whether you’re browsing our site, requesting a proposal, or hiring us to build your brand through marketing strategy and execution.

By using our website or engaging our services, you agree to these Terms. If you don’t agree, don’t use our site or services.

1. Who We Work With

Surge Media partners with business owners, founders, and growth-minded teams in industries such as:
Home Services
Restaurants & Food Brands
Credit Repair & Coaching
Education & Training Providers
We reserve the right to accept or decline projects based on fit, scope, or ethical alignment. We don’t do shady stuff, and we won’t help you do it either.

2. Scope of Services

Our offerings may include:
Paid Advertising (Meta, Google, TikTok, etc.)
Web Design & Development
CRM Automation (GoHighLevel, Mailchimp)
Email & SMS Campaigns
Funnel Strategy & Creative Production
Client Dashboards and Performance Reports
Each engagement is guided by a written agreement or onboarding form that outlines deliverables, timelines, and pricing. Any changes to the scope must be agreed to in writing.

3. Client Responsibilities

You, as the client, agree to:
Provide accurate business information, content, and credentials
Grant us necessary platform access (Ad Manager, website, CRM, etc.)
Communicate in a timely and professional manner
Follow platform policies (Meta, Google, GHL, etc.)
Pay invoices on time
We’re performance-driven, but marketing is collaborative. Delays in feedback or missing assets may affect timelines and results.

4. Payment Terms

Unless otherwise agreed:
Services are prepaid monthly or per project.
Late payments may result in a pause or termination of services
No refunds once a project or campaign has started
Invoicing is typically done via Stripe, QuickBooks, or GHL billing
If you wish to cancel a monthly retainer, written notice must be given at least 7 days before the next billing cycle.

5. Performance Disclaimer

We use proven strategies, industry best practices, and data to guide your campaigns. That said, marketing results vary due to platform changes, competition, and market behavior.

6. Intellectual Property

You own all content you provide to us (logos, images, brand assets).
Final deliverables created by us and paid for in full are yours to use.
Surge Media retains rights to all internal processes, templates, strategies, and systems used to deliver your service.
Unless you opt out, we may showcase non-confidential aspects of your project in our portfolio or marketing.

7. Confidentiality

We respect your privacy and business strategy. We will not share sensitive business information, ad data, or performance metrics with anyone outside of Surge Media without your consent, unless legally required.

8. Limitation of Liability

We’re not liable for:
Platform issues (e.g., Meta bans, algorithm changes)
Lost revenue due to 3rd party outages or ad disapprovals
Data loss from user-side error or revoked access
Consequences of using inaccurate or incomplete information you provide
Our liability is capped at the amount you paid us in the previous 30 days.

9. Termination

We or you may terminate our working relationship at any time with written notice. Reasons for termination may include:
Non-payment
Misalignment of expectations
Unreasonable communication gaps or unprofessional behavior
We’ll always aim to resolve issues professionally before pulling the plug.

10. Changes to These Terms

We may update these Terms from time to time. We’ll update the “Last Updated” date at the top when we do. Continued use of our services means you accept the updated Terms.
